GENERAL TERMS AND CONDITIONS OF SALE

Scope

The general terms and conditions of sale described below govern the commercial relationship between users of the David & David Studio website (hereinafter referred to as "User" or "Customer") and the David & David Studio brand (hereinafter "D&D") belonging to the company Maison Crush, whose registered office is located at 17 Boulevard du Fust, 26200 Montélimar, France. Placing an order on the David & David Studio website by the User implies unreserved acceptance of the general terms and conditions of sale in force on the day of the order, unless otherwise agreed in writing beforehand.

David & David Studio reserves the right to modify certain provisions of its general terms and conditions of sale from time to time. Users should therefore review the general terms and conditions of sale before placing any order on the website. Any such modifications will take effect upon being published online (the publication date is indicated at the end of these terms and conditions) and cannot apply to contracts concluded prior to that date.

These conditions govern the sales of photographs, frames or any other item offered on the site to the exclusion of different provisions, in particular those in force for sales in the showroom Le QUAI, 17 Bd du Fust, 26200 Montélimar or at trade or public fairs in which D&D Studio participates, as well as in stores distributing David & David Studio photographs.

These General Terms and Conditions of Sale govern only D&D's relationship with its private customers. D&D's professional customers may access the professional section of the website, which is reserved for them, only after completing the specific business information form to verify their professional status (in the fields of art, decoration, framing, hospitality, etc.) and after receiving explicit written consent from D&D.
D&D also reserves the right to refuse access to the professional section of its site without having to justify its decision.

Price

The prices in effect are those displayed on the D&D website on the day the order is placed, subject to availability. D&D reserves the right to change its prices at any time.

Prices are shown inclusive of all taxes (TTC), excluding shipping costs.

For orders delivered to countries other than mainland France, the user is considered the importer of the ordered products. For shipments outside the European Union or French overseas departments and territories (DOM-TOM), customs duties or local taxes may be applied by the authorities of the destination country. These duties, taxes, and mandatory declarations are not the responsibility of D&D and remain the sole responsibility of the user, who must inquire with the authorities of the importing country before placing an order on the D&D website.

Placing an Order

Use of this site is restricted to individuals over 18 years of age and legally capable of entering into contracts. Users are deemed to have read and accepted these terms and conditions of sale.

The User guarantees the accuracy of the information he or she provides on the D&D website.

It is the User's responsibility to place the order by entering all the necessary information for billing and delivery of the chosen items.

To place an order, the user must go through different pages of the D&D website.
The user must first select the desired image, format, finish, and quantity. They then add the item to their "shopping cart" and can either continue shopping on the site or confirm their order.

If not already registered, the User must register and accurately provide all information regarding their delivery and billing addresses.
After validating their details, the user can choose their payment method.

The validation of the order by the customer constitutes an irrevocable commitment which can only be challenged in the limited cases provided for by these conditions (see: right of withdrawal)

All orders are considered firm and can only be cancelled with the consent of D&D, and if so, subject to the payment of compensation for the loss or damage caused by such cancellation.

The items offered by the D&D website are printed and manufactured on demand.
Therefore, no stock information is displayed on the website. With few exceptions, all items available for order on the day the order is placed are likely to be shipped.
In the event of a temporary shortage or unavailability of certain items, the corresponding items appear in grey on the product page and become inactive, making it impossible for the user to order them.

In the event that non-stocked products become unavailable after the User places an order, D&D will notify the Customer by email as soon as it becomes aware of this unavailability. The order may then be modified by the User selecting a replacement product, or cancelled if no suitable replacement product is available. The User will then be refunded if their bank account has already been debited.

Products - Availability - Delivery time

D&D offers photographic prints and graphic works produced digitally on paper in various sizes, as well as framed photographic prints and graphic works. These items are also available in different formats and finishes. The list of available products and formats for a given image is indicated on the corresponding product page. If the desired format or finish appears grayed out on the product page, it means that the product(s) are temporarily or permanently unavailable and can no longer be ordered from the D&D website.

All printing and finishing work is done on demand in D&D's workshops.

D&D processes print orders in the order they are received. Shipping times are indicative (less than 4 days, except in cases of force majeure).

Unless otherwise expressly stated in writing by D&D to a Client, a manufacturing lead time of less than one month cannot give rise to any order cancellation or claim for compensation of any kind.

Delivery times, regardless of the mode of transport used, are also given for information purposes only and do not constitute a commitment on the part of D&D.

Payment

Full payment is due upon ordering.

Several payment methods are offered to pay for an order on the D&D website:

  • By bank card
    Credit card payments are secured by Shopify's payment system. The user's bank details are encrypted (SSL technology: Secure Socket Layer) and are not shared with D&D. They are not transmitted unencrypted over the internet and cannot be intercepted.
  • Via PayPal

The order will only be shipped after receipt and validation of payment, regardless of the payment method chosen by the User.

The data recorded by D&D constitutes proof of all transactions between D&D and its customers. The data recorded by Shopify's payment system constitutes proof of financial transactions.

Order confirmation

Provided that the user has provided a valid email address, once the order is finalized and the payment method is validated, D&D sends the user an automatic order confirmation email.

A second automated email is sent when the shipment is handed over to the carrier.

Delivery

The available delivery methods depend on various factors such as the number and size of the item(s) ordered and the delivery country. D&D reserves the right to choose the carriers offered to the customer.

The delivery date depends on the type of item ordered and the manufacturing method (see Delivery Time). Unless otherwise specified, D&D groups all items ordered into a single shipment. In this case, the shipping time will depend on the item with the longest manufacturing time.

Once the shipment is handed over to the carrier, it is solely responsible for delivery times (except in the case of user errors when entering their data). Therefore, no claim for compensation of any kind may be made against D&D by the customer.

Shipping costs

Shipping is free for orders over €100 within the EU. Below this amount, shipping costs €6 for France and €10 for the rest of Europe. For all orders outside Europe, shipping costs must be calculated before the order can be confirmed by the customer. Shipping costs depend on the weight/volume of the order and the destination country.

Reception

D&D takes the utmost care in packaging and protecting ordered items. With this in mind, and to prevent any risk of breakage, D&D uses synthetic glass for framed posters.

However, it is the customer's responsibility to check (or have checked if they are not receiving it directly) the perfect condition of the package received and to open it in the presence of the delivery person to check that the item, or items, arrive(s) in good condition.

In case of a problem, return the package to the delivery driver, stating the issue, without signing the delivery slip. No claim will be accepted if the delivery slip is signed. You should also contact our customer service department on the same day.

  • Article L133-3 of the Commercial Code:
    "Acceptance of the transported goods extinguishes any action against the carrier for damage or partial loss if, within three days, excluding public holidays, following the date of acceptance, the consignee has not notified the carrier, by extrajudicial act or registered letter, of their reasoned protest."

Right of withdrawal, return and exchange

The customer has thirty calendar days to return any artwork that does not meet their expectations. This right does not apply to gift vouchers or orders placed by businesses.
To do this, the Customer must contact customer service who will tell them the procedure to follow and the return address.
Items must be returned in perfect condition, in their original packaging.
D&D will reimburse the Customer within 30 days after receiving and checking the returned items for the price of the returned items, excluding the initial shipping costs.
Return shipping costs are the responsibility of the customer. If D&D arranges the return on behalf of the customer, the return shipping costs will be deducted from the refund amount.
Items returned without their original packaging, or damaged, will not be accepted.

In the event of a delivery error on the part of D&D (goods not conforming to the order for example) the Customer must contact customer service who will indicate the return or exchange procedure.

Disputes

Complaints or disputes will always be received with care. In the event of a dispute, you should first contact Maison Crush by mail at 17 Boulevard du Fust, 26200 Montélimar, or via the contact form on the D&D website (CONTACT tab), or by email at: contact@david-david-studio.com in order to seek an amicable solution.

In the event of a dispute relating to the interpretation or execution of these general terms and conditions, the Commercial Court of Valence shall have sole jurisdiction.

Guarantees

D&D strives to keep the information published on the site up to date to the best of its ability.
D&D reserves the right to modify the content of its site at any time and without notice.

D&D cannot, however, guarantee the complete accuracy, precision or completeness of all the information appearing on its site.

Therefore, D&D disclaims all responsibility for any technical problems, bugs, or service interruptions. Likewise, it disclaims all responsibility for any damages that may result from fraudulent use or intrusion.

Confidentiality

D&D guarantees the confidentiality of the personal information entered.

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, modify, rectify, or delete your personal data. You can exercise this right by sending a letter to the following address: Maison Crush, 17 Boulevard du Fust, 26200 Montélimar, France.

When you register, place an order, or participate in other transactions, D&D offers you the opportunity to receive its newsletters, promotional offers, and/or to subscribe to be notified of exclusive sales, new product releases, and offers from its partners. You can modify your subscription at any time via the hyperlink at the bottom of the emails you receive.

D&D undertakes to effectively take into account changes to subscription or unsubscription to commercial emails distributed by it as soon as possible depending on the necessary processing.

Intellectual and artistic property

All elements, texts, illustrations and images present on the D&D website are protected under copyright law, trademark law, design law and all other intellectual property rights in France and throughout the world.

Therefore, any reproduction, in whole or in part, of the catalog or images on the D&D website is strictly prohibited, regardless of the method or medium. Any use must be subject to prior agreement from D&D and must have received written authorization from D&D, except as provided for in Article L122-5 of the French Intellectual Property Code, under penalty of constituting an infringement.

The buyer's rights to products purchased from D&D are reserved for strictly private use and exclude the right to reproduce or represent them.

The artist retains copyright to their creation, as defined by French law.

Entire Agreement

A change in regulations or laws rendering one or more clauses of these terms and conditions of sale null and void shall not affect the validity of these terms and conditions of sale. Such a change or finding shall in no way allow the customer to disregard these terms and conditions of sale.

If a condition was not explicitly mentioned, it would be considered as governed by the practices in force in the distance selling sector whose companies are headquartered in France.

Duration and application

These general terms and conditions of sale apply for the entire duration that the services offered by D&D are available online. They are subject to change at any time.

Furthermore, D&D reserves the right to temporarily suspend its website during periods when it is unable to adequately fulfill orders. These periods of inactivity will be announced on the website's homepage, specifying the expected date for the resumption of normal D&D operations.
